Terms of User AgreementYour use of this website means you agree to the following terms of use (the "User Agreement"). If you do not agree with these terms you should leave this website (the "Site") immediately, not use the files herein, and/or not subscribe to this service. Any Content downloaded by you from this Site, including, without limitation, any web images, video, and general information generated by the this site (collectively, the "Content") is not licensed to you by Christensen Arms. Downloading the Content does not transfer title to the Content, or any intellectual property rights therein, to you. You may not redistribute or sell the content.
Access and ServicesWe will charge you an annual fee for a Christensen Arms subscription. We may add, change or discontinue certain access levels or services on our system from time to time, and we will try to let you know about such changes a month or more in advance. We may send you e-mail announcements about our own products and services, and you agree that we may do so. Your account is for your use only. You agree not to give your password to anyone else, or allow another person to use your account. You agree to be responsible for all uses of your account for any purposes. Protect your password!
You agree that we have the right to delete all member pages created by you, files and/or other information you have on our system if your Christensen Arms account is terminated, for any reason, by either you or by us.
Payments and Refunds The price of the service is $39.95 per year. We do not provide refunds; if you cancel before the year is up, we will not refund the unused portion of your subscription. Service is not automatically renewed each year; you will receive an e-mail notice when your subscription is about to expire. You may then renew online, or let your subscription expire. We can change the rates and otherwise modify these Terms and Conditions at any time. Changes are effective 30 days from posting to our website. If you are terminated for any reason from our services before your membership expires, you will not get a refund of your annual membership payment for the current year of membership.
Acceptable Use PolicyChristensen Arms member accounts may only be used for lawful purposes. Transmission of any material in violation of any U.S. or state regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. You agree to indemnify and hold harmless Christensen Arms from any claims resulting from your use of the service, which damages you or another party. Any attempt to access or modify computer system information or to interfere with normal system operations, whether on the equipment of Christensen Arms or of any computer system or network that is accessed via the Christensen Arms communications service, will result in the immediate termination of your account. These unauthorized activities include, but are not limited to: guessing at or using passwords other than your own, accessing information that doesn't have public access permissions, and accessing any computer system on which you or the public are not welcome. Don't abuse your account privileges. You agree not to tell others your password or let your account be used by anyone except yourself. You agree not to attempt to log in more than once at the same time on any given account without specific permission of a system administrator.
Content/Activity Prohibited
Content/Activity Prohibited. The following is a partial list of the kind of Content that is illegal or prohibited to post on or through the Christensen Arms Services. Christensen Arms reserves the right to investigate and take appropriate legal action against anyone who, in Christensen Arms sole discretion, violates this provision, including without limitation, removing the offending communication from the Christensen Arms Services and terminating the Membership of such violators.
Prohibited Content includes, but is not limited to Content that, in the sole discretion of Christensen Arms:
- is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
- harasses or advocates harassment of another person;
- exploits people in a sexual or violent manner;
- contains nudity, violence, or offensive subject matter or contains a link to an adult website;
- solicits personal information from anyone under 18;
- provides any telephone numbers, street addresses, last names, URLs or email addresses;
- promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
- promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
- involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
- contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
- furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
- solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
- involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
- includes a photograph of another person that you have posted without that person's consent
Other Content/Activity Prohibited
- No foul, obscene, vulgar, sexually oriented, hateful, threatening, or abusive language is allowed. This includes words that include * and are used in place of characters. Most people still know what the word is and what it means. It is offensive and will be removed.
- No off-topic messages or threads. We currently forums meant for a specific topic. For example, the Mule Deer forum is meant for our visitors to talk about mule deer hunting. If your thread or message is not about mule deer hunting, it may be removed or moved to the appropriate forum. If your thread or message is off-topic, it will be removed or moved to the appropriate forum.
- No threads are allowed that single out an individual. If you have a problem with someone, or disagree with the way in which a person acts or what a person has done, take it up with them. DO NOT post it in our forums. Any messages that mention a persons name may be removed.
- Please, do not post messages that question our moderating. If you have a question or complaint, please email us. If posted on the board, it will be removed.
- No advertising. This includes both commercial and non-profit organizations. If you would like information about advertising on the Christensenarms.com website, drop us a line.
Limitation of Liability and IndemnityYou agree that your use of this system is at your sole risk. You agree that we will not be responsible to you for any indirect, consequential, special or punitive damages or losses you may incur in connection with our system or any of the data or other materials transmitted through or residing on our system, even if we have been advised of the possibility of such damage or loss. In addition, you agree to defend and indemnify us and hold us harmless from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable attorneys fees) relating to any acts by you or materials or information transmitted by you in connection with our system leading wholly or partially to claims against us or our system by other customers or third parties. Choice of Law Christensen Arms can be reached by individuals from all 50 states of the US, and around the world. Each of these places has a different set of laws. Since we cannot keep track of all these laws and their requirements, you agree that the law of our own state, Utah, will apply to all matters relating to this Agreement and to Christensen Arms. In addition, you agree and consent that if you ever take legal action against us, the courts of our own state, Utah, will have exclusive jurisdiction over any such legal actions. The following legal language makes this agreement binding: THIS AGREEMENT SHALL FOR ALL PURPOSES BE GOVERNED BY AND INTERPRETED AND ENFORCED IN ACCORDANCE WITH THE LAWS OF THE STATE OF UTAH. THE PARTIES HEREBY AGREE THAT ANY ACTION ARISING OUT OF THIS AGREEMENT MAY BE LITIGATED UNDER THE LAWS OF UTAH, AND HEREBY AGREE TO SUBMIT TO THE JURISDICTION OF THE COURTS OF THE STATE OF UTAH, AND THAT SERVICE OF PROCESS BY CERTIFIED MAIL, RETURN RECEIPT REQUESTED, SHALL BE SUFFICIENT TO CONFER IN PERSONAM JURISDICTION OVER THE PARTIES HERETO. ALL RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED.
GeneralThis agreement is the entire understanding between you and us regarding your relationship to Christensen Arms. If either you or we fail to notify the other of any violations of this agreement, this will not mean that you or we cannot notify the other of future violations of any part of this agreement.
